  • Trial court verdict was based on misreading of material and unsustainable.
  • High Court termed the findings of trial court as perverse.
  • High Court gives credence to the testimony of Bina Ramani, her daughter Malini and Canadian husband George Mailhot.
  • High Court says two weapon theory was a concoction which was introduced first time by the complainant Shyan Munshi, who turned hostile in the case.
  • Statement of Bina Ramani clearly shows that she had herself seen Manu Sharma shooting Jessica Lall as otherwise she had no reason to ask him why he had shot Jessica.
  • Raps special public prosecutor for deliberately making a concession that Bina Ramani was not an eye witness.
  • Holds testimony of CFSL witnesses as unworthy on two weapon theory terming their statements as "sudden emergence of the worksheet".
