UP recruitment scam: SC stays HC order for CBI probe

The Supreme Court on Monday stayed an Allahabad High Court direction for a CBI probe into the "UP police recruitment scam" that had allegedly taken place during the Mulayam Singh Yadav regime after the Centre expressed its inability to allow the premier investigating agency to probe the matter.

New Delhi, Sept 15: The Supreme Court on Monday stayed an
Allahabad High Court direction for a CBI probe into the "UP
police recruitment scam" that had allegedly taken place during
the Mulayam Singh Yadav regime after the Centre expressed its
inability to allow the premier investigating agency to
probe the matter.

A bench of Justices C K Thakker and D K Jain in an
interim order while staying the direction issued notices to
the UP Government and Amit Kumar Shukla, petitioner before the
High Court to file their responses on the Centre`s claim.

Solicitor General G E Vahanvati in a brief submission,
said the CBI would not be in a position to take up the probe
as it was preoccupied with various other investigations.

The Centre had filed the SLP before the apex court in
response to the February 2008 direction of the High Court to
the CBI to conduct investigations into the scandal as names of
several top politicians and high ranking police officials
figured in it.

The High Court had ordered a CBI probe on the writ
petition of an aggrieved candidate and the Mayawati Government
also supported the plea for a probe by the central
investigating agency.

According to a high-level inquiry committee appointed by
Mayawati, the recruitments were not only done for money and
political consideration, but sexual favours were obtained from
some of the girl recruits before being appointed.

Over 15,000 of the recruits have already been sacked by
the Mayawati government pending a final decision on the issue
that rocked the state.

Even as the Mayawati government after assuming power
urged a CBI probe, one of the aggrieved candidates Amit Kumar
Shukla approached the High Court seeking a probe by the
Central agency since top IPS and state police officials were
allegedly involved in the racket.

It was the case of the petitioner before the High Court
the a CBI probe was essential as besides politicians, one
Additional DGP, two IGs, 16DIGs, one SSP, 33 Additional SPs
besides, 77 DSPs were allegedly involved in the racket, hence
it would not be possible for the state police to conduct
a probe in a free and fair manner.
