Sabharwal`s son to approach SC against court`s order

After a Nagpur court acquitted all six ABVP activists, accused of beating to death Prof H S Sabharwal in Ujjain, the slain teacher`s son today said he will file an appeal against the judgement in Supreme Court.

will file an appeal against the judgement in Supreme Court.

"I will appeal against the Nagpur court judgement within
four days in the Supreme Court," Himanshu told PTI over phone.

Professor Sabharwal, head of Political Science Department
at Madhav College, died, three years ago, after he was
allegedly beaten up by Akhil Bhartiya Vidhyarthi Parishad
activists amidst a fracas over student union elections in the
college. He had later succumbed to his injuries in a hospital.

The Supreme Court had transferred the case to Nagpur
following an appeal by Himanshu to transfer the case to a
non-BJP-ruled state as all the accused belong to student wing
of the ruling BJP in Madhya Pradesh.

"It was Supreme Court`s decision that police cannot go
back on its statement during the trial but in this case, they
have retracted from their earlier statements," he said.

"Secondly, if the ABVP members were not guilty then why
they were kept in the prison for so long in a BJP-ruled
state," he asked?

Himanshu also doubts the forensic tests report which were
conducted in the BJP-ruled Gujarat while the trial was being
conducted in the Congress-governed Maharashtra.

The court also did not entertain media reports which
claimed that two crucial witnesses Komal Singh and Manoj Dodia
were under pressure to withdraw from their earlier statements,
he said.

The slain professor`s son said that the judge has ruled
that since there was no evidence available against the
accused, therefore, he has no other option but to acquit them.

Himanshu said that since the beginning he has been saying
that the BJP government in the state would carry out an
eyewash in the case as Chief Minister Shivraj Singh Chouhan
himself said that the killing was merely an "accident".

Meanwhile, Chouhan today said that the court verdict has
proved that it was a "normal accident".

"I have said earlier that it was a normal accident and
the court verdict in the case has also established it,"
the Chief Minister told reporters in Gwalior.
