Geneva, Nov 15: A United Nations body condemned
Canada for expelling an Indian who was tied during his flight
home and allegedly beaten on his return.
The "expulsion of an individual to India who had been
bound during the flight back, and who had subsequently been
beaten and humiliated on his return had been in violation of
article 3 of the Convention," the UN anti-torture committee
said in a statement.
The article stipulates that it is an obligation not to
send an individual back to a country where he or she is at
risk on torture or ill-treatment.
It said ottawa had not followed its recommendation to
compensate the individual and criticised it for "basing its
deportation decision on information that had not been
available to the individual."
However the body noted that Canada had since amended "its
legislation in this area."
